NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS December 4, 2025 City of Atlanta, GA Department of Grants and Community Development 55 Trinity Avenue, SW Suite #3500 Atlanta, GA 30303 404-658-7820 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by The Housing Authority of the City of Atlanta, Georgia. REQUEST FOR RELEASE OF FUNDS On or about December 22, 2025, the City of Atlanta will authorize The Housing Authority of the City of Atlanta, Georgia ("Atlanta Housing") to submit a request to the HUD Atlanta Regional Office for the release of funds under the Housing Act of 1937 and Consolidated Appropriations Act, 2012, as amended, to undertake a project known as Asbury Pointe for the purpose of constructing 102 units at the currently vacant property located at 884 McDonough Boulevard SE, Atlanta, Georgia. The Metro Atlanta Land Bank is the current owner of the site and will transfer the land to the Atlanta Urban Development Corporation ("AUDC"). AUDC will enter into a ground lease option agreement with the Developer, Wendover Housing Partners. Asbury Pointe is a proposed 102-unit, modern garden-style community for families situated on 5.28 acres. One unit will be an employee/common space unit, and the remaining 101 units will be affordable tax credit units. The community will be comprised of one clubhouse building and 3 three-story residential buildings, each of which will include one-, two-, and three-bedroom units. The community will consist of 50%, 60%, and 80% AMI units, as well as one common space unit. Soil remediation is required at the property. Approximately 250 cubic yards of impacted soil will be remediated within 30 days following acquisition of the project site. In accordance with correspondence from the Georgia Environmental Protection Division (GA EPD) and approved deferment determination, complete soil remediation will be conducted under state cleanup requirements. Following construction, radon testing will be conducted in accordance with industry standards, and a radon mitigation system will be installed if post-construction levels exceed 4 picocuries per liter (pCi/L). Noise mitigation is required at the site to reduce interior noise levels in areas exposed to traffic noise from McDonough Boulevard. A noise attenuation plan has been prepared and will be followed. Mitigation at the site will be implemented primarily through strategic building design and construction practices aimed at reducing interior noise levels in areas exposed to traffic noise. This will involve using construction materials with specific Sound Transmission Class (STC) ratings for walls, windows, doors, and ceilings, as outlined in the Noise Attenuation Plan. Additional measures include avoiding wall-mounted HVAC units, using lined ventilation ducts, sealing all wall penetrations with acoustic caulk, and considering room layout and finishes to maintain acoustic integrity. These mitigation strategies will apply to all occupied spaces, including residential units. The Developer will incorporate noise attenuation measures. Tribal consultation was conducted for the project site. Atlanta Housing will continue to cooperate with the tribes and request further consultation if project plans change in any way. The estimated total project cost is $32,617,355. Atlanta Housing is proposing to use MTW funds to provide 21 Restore Rebuild Project-Based Vouchers to Asbury Pointe for a period of twenty years, subject to an extension. The estimated amount for a period of twenty years is $7,003,694. The project cost includes funding to cover the soil remediation, radon testing and mitigation, and noise mitigation. Atlanta Housing will not use their HUD funds for these items. FINDING OF NO SIGNIFICANT IMPACT The City of Atlanta has determined that the project will have no significant impact on the human environment if the conditions for Noise Abatement and Control, Historic Preservation, and Contamination and Toxic Substances are followed. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review electronically. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Atlanta, Department of Grants and Community Development, Office of Entitlement and Competitive Compliance by email at gmenvironmentalreview@atlantaga.gov. All comments received by December 19, 2025, will be considered by the City of Atlanta prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Atlanta certifies to HUD that Deborah B. Lonon in her capacity as Commissioner consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows AH to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Atlanta's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Atlanta; (b) the City of Atlanta has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Tosha LeSure at Tosha.R.LeSure@hud.gov or 77 Forsyth Street SW, Atlanta, GA 30303.
