NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS August 20, 2025 City of Atlanta, GA Department of Grants and Community Development 55 Trinity Avenue, SW Suite #3500 Atlanta, GA 30303 404-658-7820 These notices shall satisfy a procedural requirement for activities to be undertaken by The Housing Authority of the City of Atlanta, Georgia. REQUEST FOR RELEASE OF FUNDS On or about September 5, 2025, the City of Atlanta will authorize The Housing Authority of the City of Atlanta, Georgia ("Atlanta Housing or "AH") to submit a request to the HUD Atlanta Regional Office for the release of funds under the Housing Act of 1937, as amended, for the Former Bowen Home Redevelopment. The proposed development will be new construction and consists of multiple phases of residential development as well as commercial and education facilities over approximately 74 acres. AH is partnering with McCormack Baron ("MBS") and the Benoit Group ("TBG") to develop the entire site. The initial housing focus will be on what is referred to as the "CNI site" of approximately 25 acres. Vertical construction on the remaining acreage will begin following the completion of 6 CNI phases on or before September 2032. There will be a total of 11 residential phases including 2,000 housing units consisting of affordable, senior, workforce, and market rate units. The 12th and final phase will focus on commercial use. The number of units for the initial 6 phases is as follows: Phase 1-151 units, Phase 2- 112 units, Phase 3- 163 units, Phase 4- 113 units, Phase 5-100 units, and Phase 6-117 units total 756 units. The balance of the residential development will include 1,244 units, 1,026 of those units are currently contemplated to be affordable. The first 6 CNI phases will undergo the Restore-Rebuild conversion process. Beginning at each phase's Mixed Finance closing, and at the end of construction, AH will begin a RAD closing known as Restore-Rebuild Each development pad will include amenity areas and management offices. The redevelopment of the site will also include a recycling center, environmental education center, stormwater management park areas, and a memorial plaza. The site will include parking and driveway areas that service each residential and commercial area. The site will be zoned for multifamily housing and commercial use. AH will coordinate with the Georgia Environmental Protection Division to remediate the buried debris area located on the northwest portion of the property. Radon sampling will be completed following construction. If elevated radon levels are detected above 4.0 pci/L, radon mitigation measures must be implemented in accordance with the ANSI/AARST mitigation standard to install the radon reduction system and follow the operation, maintenance, and monitoring plans. The estimated total HUD funded amount is $68,000,000.00. AH is proposing to use MTW and Choice Neighborhoods funds. The total estimated project cost is $775,700,590.00. AH plans to use MTW funds to remediate the northwest portion of the site. The remediation planning is still in progress, but it is estimated that the remediation will cost approximately $3,000,000 to excavate the debris. AH is exploring a capping option to reduce the costs. The City of Atlanta Department of Grants and Community Development (DGCD) will be committing $2,000,100.00 in Community Development Block Grant (CDBG) funds in the form of Supplemental Assistance to cover the costs of clearing and grubbing, excavation and stockpiling of soil, compaction of soil, installation outlet control structures, utility relocation, erosion control, and landscaping. FINDING OF NO SIGNIFICANT IMPACT The City of Atlanta has determined that the project will have no significant impact on the human environment if the conditions for Contamination and Toxic Substances are followed. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record. The ERR will be made available to the public for review electronically. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Atlanta, Department of Grants and Community Development, Office of Entitlement and Competitive Compliance by email at gmenvironmentalreview@atlantaga.gov. All comments received by September 4, 2025, will be considered by the City of Atlanta prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Atlanta certifies to HUD that Deborah B. Lonon in her capacity as Commissioner consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Atlanta to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the City of Atlanta's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Atlanta; (b) the City of Atlanta has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to CPDRROFATL@hud.gov and Tosha LeSure at Tosha.R.LeSure@hud.gov.
