COMBINED NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Georgia Department of Community Affairs (60 Executive Park South, NE Atlanta, GA 30329-2231; (404) 596-2626; Samanta Carvalho, Certifying Officer) REQUEST FOR RELEASE OF FUNDS At least one day after the end of the comment period the Georgia Department of Community Affairs (DCA) will submit a request to the US Department of Housing and Urban Development (HUD) for the release of HOME Investment Partnerships Program funds (Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990) for the following project: Abbington at Ormewood (new multifamily residential construction) Rea Ventures Group, LLC: Trey Coogle, 404-250-4093 (Grant Recipient/Developer) Atlanta, Fulton County, Georgia (Project location) $21,200,224 (Estimated total cost) FINDING OF NO SIGNIFICANT IMPACT The Georgia Department of Community Affairs (DCA) received an application in July 2022 for the award of federal HOME funding for the development of this project. DCA has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) prepared by DCA. This ERR is on file at DCA at 60 Executive Park South, N.E. Atlanta, GA 30329 by appointment only and may be examined or copied weekdays from 8:30 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency wishing to comment on the project or ERR may submit written comments to Samanta Carvalho, from March 26, 2023April 10, 2023. All comments must be received by within the fifteen (15) day comment period. RELEASE OF FUNDS DCA certifies to the HUD that Samanta Carvalho in her capacity as Director, Office of Community Housing Development consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The HUD approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows DCA to use Program funds. OBJECTIONS TO RELEASE OF FUNDS Following its receipt of DCA's request for release of funds, HUD will accept objections to the release of funds or DCA certification for a period of fifteen days only if the objections are made on one of the following bases: (a) The certification was not executed by the Certifying Officer of DCA; (b) DCA has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) The grant recipient or other participants in the development process has committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the HUD; or (d) Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Atlanta CPD Field Office at CPD_COVID-19OEE-ATL@HUD.gov. Potential objectors should contact the Atlanta CPD Field Office via email to verify the actual last day of the objection period. 3-26-23
